hope that means they are willing to talk about giving EAD. If we get EAD all the lawsuits will be withdrawn. The law does not say AOS applications should not be accepted when there are no visa numbers available, the law only says AOS cannot be approved when visa numbers are not available. USCIS internal regulations says they will not accept AOS applications when priority date is not current. by now its quite apparent that USCIS has broken a lot of there own internal regulations just to make sure the visa numbers are used up before july 2 2007. Then can easily accomodate the EAD for july filers. It all depends upon the pressure exerted on USCIS and DOS
Pitha -- the law says quite clearly that AOS applications cannot be filed if visa numbers are not available. Which is why IV was trying to get in an amendment that says AOS can be filed even when visa numbers are not available.
USCIS would fight a change in this tooth and nail -- cos as the Ombudsman has reported again and again in his annual reports -- when they spend a huge amount of time churning out EADs and APs, actual adjudications of green cards fall behind. Then there are the people (incl Ombudsman) who say that such interim benefits (EAD AP) should not be granted to such large numbers of people without security checks etc.
My guess is that this is precisely why USCIS didn't want the all current situation. They don't want to be stuck with 700K applications which have no hope of getting a greencard for years upon years, while they churn out EADs and APs for all those years.
Of course, one fix would be to increase the EAD time period to 3 yrs. Something they have been unwilling to do.

Very well written. We need this kind of language material to present to our friends. You got my contribution. How do I donate $20? I don't see tab for that money on page. Minimum for one time contribution I see is $100. Also is there any way that I do not have to use paypal and directly use my cc to pay?

So we surely need some convincing on part of IV. This post I see is right step. I need some more info to present to my friends, as to why they should contribute. That would be perfect.

1. More immigrant visas for those who are in the queue alredy(employment based)
2. Asked for easy H1B 3-year extensions like in the present law
3. Allow to file I485 without visa numbers
4. Showed how illegals are being rewarded for breaking the laws, and how the legals are being punished by current bill.
Guys, it may take a while, but do e-mails and faxes. The hardest fax to reach was sen. Reid's office.

I take frequent trips to India and all of them are extremely satisfying, and many times the thought has crossed my mind about the possiblity of moving back but it will take some time for changes to happen for the good and that is because i think,
We, Indians have a basic mental flaw wherein we shy away from unpleasant confrontation regardless of the merits of our case or the adverse consequences that such inertia engenders. The net result is that we are unable to translate our moral convictions into practical reality allowing law abiding citizens to be held hostage to the tantrums of a belligerent and corrupt minority, who call the shots in most places, right from the bottom to the top , in any sphere or area...(rather than talent and merit that should call the shots )

Yes, but I won't be surprised if the USCIS lawyers interpret the law to suit their convenience. And even worse, the judge buys it.

I received my (and my family's) transfer notice (and hence the WAC### nos.) for 485 application yesterday at my residence. The cases were filed in CA by my lawyer (filing from MD). The cases have been transferred to TX.
I am yet to receive any notice/tracking no. for EAD and AP applications. The checks were made by the lawyer so that is not an option.
Questions::confused:
1) Does transfer mean delay in processing ?
2) Is EAD tracking no. different from the 485 no. ? If so, where can I get that from ?
3) Are they still issuing EADs in about a couple of months ? If so, that is great. If not, when does the 90-day clock start for INFOPASS ? (if it is an option in this incresed activity)
Any answers or discussions or links to the solutions are welcome.

i dont think we are going to solve anything by fighting among ourselves here... we have to take the fight up with USCIS and not among ourselves... the plight of EB-3 at this point is far far worse than EB-2... atleast we are current.. they are not even that.... we have to somehow include all fractions into what we do at this point....
EB-3 deserves a GC as much as an EB-2... and so let's not create boundaries here... United we stand... divided we fall...
what are our options.. to make the 500 pound gorilla kneel down ??
i remember a famous saying.. pen is mightier than the sword... so what are our options guys ???
